World of Toji (Auluka Brands Private Limited) owns the domain www.worldoftoji.com. By accessing or using this website you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, payment terms, and any additional policies referenced on the Site (collectively, “Terms & Conditions”).

1) Your Account & Registration Obligations

You may check out as a guest or create a World of Toji account. To create an account you must be competent to contract under the Indian Contract Act, 1872. Minors (under 18) may use the Site only through a parent/legal guardian. We may terminate or refuse service if an ineligible user creates or uses an account.

You are responsible for maintaining the confidentiality of your User ID and password and for all activity under your account. You agree to provide true, accurate, current, and complete information, and to promptly update your contact and payment details so we can process transactions and contact you as needed.

2) Privacy

Please review our Privacy Policy to understand our practices. You understand and agree that we may use third-party service providers to store and process your information (including in jurisdictions with different data protection laws). We do not guarantee the actions or omissions of such third parties.

3) Payment Policy

Browsing the Site is free. Product prices include applicable taxes and may include shipping charges where applicable. By placing an order, you agree to pay all charges per our payment terms. If payment is not received or is refused, we may cancel the order, suspend/terminate your account, and take lawful steps to recover dues.

International shipping is currently unavailable. If introduced later, customers will be responsible for all local duties/taxes in the destination country.

4) Products & Services for Personal Use

Products/services (and any samples) are for personal use only and may not be resold. We may cancel or reduce quantities that, in our view, could violate this policy or appear to be placed by dealers, resellers, or distributors. Certain items may be available exclusively online and in limited quantities; returns/exchanges are governed by our Return & Refund Policy.

We may modify or discontinue any product/service at any time without notice.

5) Order Acceptance, Limits & Cancellations

We reserve the right to refuse any order. We may limit or cancel quantities per person, household, or order, including orders using the same account, card, billing and/or shipping address. If we change or cancel an order, we may notify you using the email/phone provided at checkout.

6) Intellectual Property

All content on the Site and its “look and feel” (trademarks, logos, text, graphics, images, audio, software, data compilations, and their compilation/organization) (collectively, “Content”) is owned by World of Toji, its affiliates, partners, or licensors and protected under applicable IP laws.

Except for the limited licenses below or as required by law, you may not use, copy, reproduce, sell, resell, access, modify, or exploit the Site or any Content without our prior written consent.

7) Limited Licenses

We grant you a limited, revocable, non-exclusive license to access and make personal use of the Site. This does not include: framing; republishing/redistributing/selling the Site or Content (except caching/viewing); reverse-engineering; collecting account information; using hidden text/meta tags; or using robots/spiders/crawlers or similar tools that burden our infrastructure. All proprietary notices must be retained.

You may create a personal, non-commercial hyperlink to our home page provided it does not misrepresent, imply endorsement, or contain distasteful/illegal content. We may request removal of any link at our discretion.

Any unauthorized use terminates these licenses without prejudice to other remedies.

8) Your Obligations & Responsibilities

You must comply with these Terms, posted instructions, and applicable law; act in good faith; and not impair the Site or its operation. You may not alter the Site/Content. You are liable for losses caused by your breach.

9) Special Features, Functionality & Events

Promotions, contests, special features, or events may have additional or separate terms. By participating, you agree to those terms where applicable.

10) User Content

You are solely responsible for any content you post or transmit (“User Content”). You agree not to upload content that is unlawful, harmful, defamatory, obscene, infringing, misleading, or violates others’ rights; or to transmit viruses, spam, or engage in harassment/impersonation. We may refuse, remove, or edit User Content at our discretion. Do not post about or use World of Toji’s content on social platforms without permission.

11) Submissions

Unsolicited suggestions/ideas (collectively, “Submissions”) are non-confidential and non-proprietary. Subject to the Privacy Policy, you grant us a perpetual, worldwide, royalty-free license to use, copy, modify, publish, distribute, and create derivative works from Submissions in any media. You represent and warrant that you own/control rights in your Submission and that it does not contain viruses, solicitations, or spam. You agree to indemnify us for claims arising from your Submissions.

12) Accuracy of Information; Pricing & Product Variations

We strive for accuracy but do not warrant that descriptions, colors, or other content are error-free, current, or complete. Prices and descriptions may change without notice. Because our products are handmade by artisans, slight variations in size, color, or design may occur and are inherent to the craft. Display colors may vary by device.

We do not warrant that product quality will meet your expectations or that errors will be corrected.

13) Third-Party Links & Tools

We are not responsible for content, policies, or practices of off-site pages or third-party websites/tools linked to/from the Site. Use is at your own risk and subject to those third parties’ terms and privacy policies.

14) Copyright Complaints

If you believe your copyright is infringed, email hello@worldoftoji.com with: (i) identification of the copyrighted work and proof you are the owner/authorized agent; (ii) description and URL/location of the allegedly infringing material; and (iii) your contact details. This address is only for IP notices.

15) Representations, Warranties & Limitation of Liability

The Site is provided “as is”. To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for: business interruption; access delays; data non-delivery or corruption; losses from third-party links; viruses/system failures; inaccuracies/omissions; or events beyond our control. We are not liable for product-related issues beyond the terms accompanying the product.

To the fullest extent permitted by law, we shall not be liable for any indirect, special, punitive, incidental, exemplary, or consequential damages. Our maximum aggregate liability shall not exceed ₹2,000. No claim arising from the Site or these Terms may be brought more than one (1) year after it arose.

16) Indemnification

You agree to defend, indemnify, and hold us harmless from losses, damages, costs, and reasonable attorneys’ fees arising from third-party claims related to your use of the Site, your breach of these Terms, or your use of robots/spiders/crawlers or similar tools that burden our systems.

17) Disputes; Governing Law; Arbitration

Please write to hello@worldoftoji.com for grievances; we will attempt amicable resolution. These Terms are governed by Indian law. To the fullest extent permitted, disputes shall be referred to a sole arbitrator appointed by our Board under applicable law. Venue: Delhi, India. The arbitral award shall be final and binding. Where arbitration is not permitted, disputes shall be submitted to competent courts in Delhi, India.

18) Electronic Notices & Communications

You consent to receive agreements, notices, disclosures, and other communications electronically (by email and/or posting on the Site) in English. To withdraw consent, email hello@worldoftoji.com and stop using the Site. Marketing communication choices are described in our Privacy Policy.

19) General

You may not assign these Terms; we may assign without restriction. We are not responsible for delays/failures due to causes beyond reasonable control (e.g., pandemics, natural disasters, strikes, civil unrest). These Terms constitute the entire agreement and supersede prior communications. We may change these Terms at any time by posting updates; continued use constitutes acceptance. Our failure to enforce any provision is not a waiver. If any provision is invalid, the remainder stays effective and, where possible, the provision will be modified to reflect the parties’ intent.
