World of Toji provides the content and services available on this website to you subject to the following Terms and Conditions, our Privacy Policy, Payment Policy and other terms and conditions and policies which you may find throughout our website in connection with certain functionality, features or promotions as well as customer service, all of which are deemed a part of and included within these terms and conditions (collectively, “Terms and Conditions”). By accessing or using this website, you are acknowledging that you have read, understood, and you agree, without limitation or qualification, to be bound by these Terms and Conditions in this Agreement, so please read this carefully before proceeding.

Your Account and Registration Obligations

In order to use the service of World of Toji through website you may use guest login or create your own World of Toji account to use certain World of Toji services, and you may be required to be logged in to the account and have a valid payment method associated with it. To create your World of Toji account you must be eligible to enter into contract under Indian Contract Act, 1872. “Incompetent persons” under Indian Contract Act, 1872 are not eligible for World of Toji account. Any minor i.e. a person below the age of 18 years can use the website and transact only through its legal guardian or parent. World of Toji reserves the right to terminate your account / refuse to provide its services if it is discovered the person using the website and making transaction is an “Incompetent person” under Indian Contract Act, 1872 who cannot enter into contract. Any person who create account with World of Toji will be called/referred to as Registered User.

If you use the website as a Registered User, you are responsible for maintaining the confidentiality of your User ID and Password, and for restricting access to your account. You are responsible for all activities that occur under your User ID and Password. You agree, inter alia, to provide true, accurate, current and complete information about yourself as prompted by website registration form or provided by you as a visitor. If you provide any information that is untrue, inaccurate, not current or incomplete or World of Toji has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the present terms of use agreement, World of Toji has the right to indefinitely suspend or terminate or block access of your membership with the website and refuse to provide you with access to the website and to provide it services.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree and understand that World of Toji provides no guarantee, warranty or assurance that such third party service providers will protect Your personal information and we shall not be liable for any actions, commission, omission, misconduct, fraud or negligence (whether in contract or tort or under public policy) of these third parties.

Payment Policy

Membership on this website is free. World of Toji does not charge for browsing and purchasing the product from this website except for the sale price of the product, applicable taxes as per the laws of India as well as the delivery charges, if and when applicable. If you purchase any product from World of Toji, then you are obligatory to make its payment of charges as per our payment policies. If you do not make payment or refuse to make payment of charges after purchasing product or services from World of Toji, then we reserve the right to annul the order or not to deliver the said product or to take measures like issuance of warning, temporarily /indefinitely suspend or terminate your membership of the website and refuse to provide you with access to all current and future use of the website, and also reserves the right to take legal action which is permissible in law for recovery of the payments in case of non- payment of charges.

Currently, we don't offer international shipping. In future, when we do start it, all international shipping orders may attract local duties applicable in that country and accordingly the customer will have to pay such local duties/taxes.

Products and services for personal use

The products and services described on this website, and any samples thereof we may provide to you, are for personal use only. You may not sell or resell any of the products or services, or samples thereof, you receive from us. We reserve the right, with or without notice, to cancel or reduce the quantity of any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Terms and Conditions. We reserve the right to take appropriate legal action in adverse situation

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

We reserve the right at any time to modify or discontinue any product and/ or service (or any part or content thereof) without notice at any time. Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Return Policy

If so, we will notify you of this and if you choose to take advantage of these offerings, you agree that your use of those offerings will be subject to such additional or separate terms of use, rules and/or policies.

User Content

You further agree not to (i) impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity; (ii) “stalk” or otherwise harass including advocating harassment of another, entrap or harm any third party including harming minors in any way; (iii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any User Content; (iv) intentionally or unintentionally violate any applicable local, state, national or international law; or (v) collect or store personally identifiable data about other users.

We do not endorse or control the User Content transmitted or posted on the World of Toji website and therefore, we do not guarantee the accuracy, integrity or quality of User Content. You understand that by using this website, you may be exposed to User Content that is offensive, indecent or objectionable to you. You will not write anything about World of Toji on any social networking or post any of its content without the permission of World of Toji

Prices for our products are subject to change without notice. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. The artisans of World of Toji carefully construct each piece of article. Due to the handmade nature of our products, each product may vary slightly in size, color, and design. These variations are a testament to the artisanal craftsmanship and make every product unique.

However, we still make every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the product will be corrected.

Limited Licenses

 We grant you a limited, revocable, and non-exclusive license to access and make personal use of World of Toji website. Representations and Warranties and Limitation of Liability

World of Toji website is presented “As Is”. We make no representations or warranties of any kind whatsoever, express or implied, in connection with these terms and conditions or the site, including but not limited to warranties of merchantability, non-infringement or fitness for a particular purpose, except to the extent such representations and warranties are not legally excludable.

Indemnification

Disputes

We will make its best possible effort to settle the issue amicably before reaching out to the complainant and try to amicably resolve the matter prior to taking any legal recourse or defending the same.

With respect to any dispute regarding the website, all rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of India and the courts of Delhi, India, as if the Terms and Conditions were a contract wholly entered into and wholly performed within Delhi, India, subject to foreign legal mandatory provisions. To the fullest extent permitted by applicable law, any dispute, differences or claim arising out of your visit to the World of Toji website shall be referred to the sole Arbitrator appointed by our Board of Directors in accordance with the law. The venue of such arbitration shall be at Delhi, India and the award of the Arbitrator shall be final and binding on all parties and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms and Conditions shall be joined to an arbitration involving any other party subject to this Terms and Conditions, whether through class arbitration proceedings or otherwise.

To the extent arbitration is not permitted by applicable law, any dispute relating in any way to your visit to the website shall be submitted to an appropriate court or other judicial body in Delhi, India, as applicable, without prejudice to the applicable law and all applicable provisions of this Section, and subject to our right to seek injunctive or other appropriate relief in any court, if you have in any manner violated or threatened to violate our intellectual property rights and you consent to exclusive jurisdiction and venue in such courts.

Consent to receive notices electronically by posting on the website and via email

You consent to receive any agreements, notices, disclosures and other communications (collectively, “Notices”) to which these Terms and Conditions refer from us electronically including without limitation by email or by posting notices on this website. You agree that all Notices that we provide to you electronically satisfy any legal requirement that such communications be in writing in English. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control such as, pandemics, epidemics, acts of god, civil war, embargoes, strikes etc.
